Fox Applauds Senate for Passing Measure Invalidating EPA’s ‘Waters of the U.S.’ Regulations

Montana Attorney General Tim Fox released the following statement after the U.S. Senate passed Senate Joint Resolution 22, which invalidates the “Waters of the U.S.” regulation adopted by the Environmental Protection Agency and Army Corps of Engineers:

“Today a bipartisan majority of U.S. Senators passed a measure invalidating the unnecessary ‘Waters of the U.S.’ regulations adopted unilaterally by the EPA and Corps of Engineers earlier this year. This sends yet another message to the courts that the executive branch has not only overreached, but also acted in defiance of the people’s elected representatives. I am grateful to Steve Daines for his leadership on this issue and for standing up for Montana in the Senate.”

Montana and 30 other states have challenged the regulations in federal court, and in October a federal judge halted implementation of the regulation nationwide.
