Fox on Affordable Care Act Ruling: The Rule of Law Prevailed
Attorney General Tim Fox issued the following statement regarding the Fifth Circuit Court of Appeals ruling striking down the Affordable Care Act’s individual mandate:
“The U.S. Court of Appeals for the Fifth Circuit did what I asked it to do: hold Obamacare’s individual mandate unconstitutional while protecting insurance coverage for the approximately 150,000 Montanans with pre-existing medical conditions. I will continue to fight for Montanans to ensure that the rule of law prevails, as it did today.”
In April, Montana and Ohio filed an amicus brief in the case Texas vs. United States, arguing that the Affordable Care Act’s individual mandate is unconstitutional but, as a point of law, is severable from the other provisions of the Act such as protections for pre-existing conditions.
