Description:
Attendees graduating this course shall know how to identify criminal activity as it relates to asset forfeiture. Students will learn the crimes that allow forfeiture of property, and the various legal methods and techniques to seize such property. Students will also be presented with several techniques and investigation methods to assist with identifying and proving assets involved with criminal activity. Students will learn all procedures for seizing assets starting with case initiation through prosecution and the laws and rules that govern our actions as law enforcement officers.
Students will also learn the legal and proper methods of evidence destruction. Starting with Montana Code Annotated and the legal basis requirements, students will understand the process of how to legally dispose of evidence, when a court order is required and when it is not, best practices for destruction, and how to handle the common misfortunes in the evidence vault. These common issues include what to do when evidence is missing that is confirmed lost and what to do when evidence is in your evidence vault that has not case associated with it. Students will also learn about the abandonment of personal property, what is expected of them prior to destroying this property, and best ways to mitigate these situations.
