The Montana Attorney General’s Office created the Affidavit of Family Transfer Division of Land. This was created pursuant to the directive from HB 714, codified at Montana Code § 76-3-207(5). The purpose of HB 714 is to promote a uniform, consistent, and straightforward evaluation procedure for family transfer parcel exemptions throughout the state of Montana. The Affidavit applies exclusively to family transfers made pursuant to MCA § 76-3-207.
