Request Process
The Montana Department of Justice is committed to transparency and adherence to the Montana Public Records laws. To ensure efficient and proper processing of requests for Department of Justice records, all requests must be submitted exclusively via the DOJ Public Records Request Submissions application.
Requestors must sign with a Montana.gov user account and submit a new public records request form with the required fields and submit one request per form. To create a Montana.gov user account, click the Sign up link at the bottom of the Montana.gov sign in window.
Requests received through any other channel, including but not limited to email, telephone, mail, fax, or personal delivery will not be considered valid or accepted for processing under the established procedure. This requirement ensures requests are properly logged, tracked, and fulfilled in accordance to state law.
Response Time and Fees
When a records request is properly submitted through the DOJ Public Records Request Submissions application, the records custodian will respond within 5 business days of submittal. After the initial response, the records custodian will send an estimate for the actual cost the Department will incur for the processing of the request. If the request is for a single readily identifiable record, no cost will be passed to the requestor.
Except for confidential, privileged, or otherwise protected information that is not subject to public disclosure under applicable law and information withheld from public scrutiny as provided in 2-6-1003, the Department of Justice shall provide the public information to the requesting person in a timely manner after the receipt of payment from the requestor.
