The State of Montana Natural Resource Damage Program (NRDP), acting on behalf of the Governor as trustee is seeking public comment on the Draft Amendment to the Anaconda Uplands Restoration Plan (Amendment). The Amendment directs how restoration funding will be spent on Anaconda Deer Lodge County (ADLC) land now that all remedial actions, except monitoring and long-term operations and maintenance, have been completed on state-owned lands on Stucky Ridge and the Mount Haggin Wildlife Management Area. The Amendment identifies actions on ADLC lands within the Anaconda Company Smelter Superfund site that singly or in combination restores, rehabilitates, replaces, or acquires the equivalent of the natural resources injured by operations at the site. These actions aim to compensate for interim loss of injured resources and services until resources are returned to baseline. NRDP is also seeking public comment on draft environmental assessments (EAs) for restoration actions pursuant to the Montana Environmental Policy Act (MEPA). These EAs are included as attachments to the Amendment. Libby Asbestos OU3 Early Restoration Scoping

The State of Montana Natural Resource Damage Program (NRDP) is preparing an interim restoration plan for the natural resources injured by Operable Unit 3 (OU3; the mine site) of the Libby Asbestos Superfund Site. NRDP is seeking public input from interested individuals and entities on the preparation of the interim restoration plan, including allocation of $2-4 million to early restoration projects, and scoping the issues that may be associated with implementation of any proposed early restoration projects.

NRDP has prepared a memorandum that summarizes the purpose and scope of the interim restoration plan, identifies preliminary early restoration project goals, and describes how the public can participate.

      Notice of Order Approving Libby Asbestos Settlement AgreementThe State of Montana is providing notice pursuant to Section 75-10-713, MCA, that on March 23, 2023, the U.S. Bankruptcy Court for the District of Delaware entered a settlement agreement that resolves the remainder of the Montana Department of Environmental Quality’s (DEQ’s) amended proof of claim in W.R. Grace & Co.’s (“Grace”) Chapter 11 bankruptcy case for the Libby Asbestos Superfund Site. The settlement resolves the natural resource damage liability of Grace and other affiliated companies to the State of Montana for the Libby Asbestos Superfund Site and requires Grace to provide the State with financial assurance for the Kootenai Development Impoundment Dam, amongst other provisions.       Draft Programmatic Damage Assessment and Restoration Plan and Environmental Assessment for the Bridger Pipeline 2015 Yellowstone River Oil Spill

      The State of Montana Natural Resource Damage Program (NRDP), acting on behalf of the Governor as trustee, and the U.S. Fish and Wildlife Service (the Trustees), are seeking public comment on the Draft Programmatic Damage Assessment and Restoration Plan and Draft Environmental Assessment for the Bridger Pipeline 2015 Yellowstone River Oil Spill (Restoration Plan). The Restoration Plan allocates approximately $1.5 million available to restore, replace, rehabilitate, or acquire the equivalent of the natural resources injured by the oil spill.

      2023 Anaconda Uplands Restoration Plan Amendment

      The Montana Natural Resource Damage Program (NRDP), acting on behalf of the Governor as trustee, in cooperation with Anaconda Deer Lodge County (ADLC) is preparing a restoration plan amendment to the Draft Conceptual Smelter Hill Area Uplands Restoration Plan (2007; Anaconda Uplands Restoration Plan). This restoration plan amendment will govern how up to $4 million of uplands restoration funds may be spent on ADLC lands. NRDP is seeking public input on the preparation of the Anaconda Uplands Restoration Plan Amendment by soliciting proposals for restoration actions from interested individuals and entities and scoping the issues that may be associated with implementation of any proposed restoration projects.

      NRDP has prepared a memorandum that summarizes the purpose and scope of the restoration plan amendment, identifies preliminary restoration project goals, and describes how the public can participate in the presentation of the plan.
